Death by rash and Negligent driving - Appeal against acquittal - Tempo driven by accused collided with motorcyclist coming from opposite direction, while overtaking tractor - As result, motorcyclist died- Cleaner of tempo stated that accused had shown headlights to intimate motorcycle that he wanted  to overtake but motorcycle came in high speed and collided with tempo- Pillion rider of motorcycle also stated that they had noticed  tempo from distance of 100 feet, going to overtake tractor and that tempo had already crossed some distance, after having overtaken tractor- None of them stated that accused was driving tempo either rashly or negligently - Acquittal proper.
