Disposing the application submitted by RTI activists and the leader of AAP Dinesh Chadha, National Green Tribunal (NGT) has mentioned the failure of the part of the Government of Compliance with its order to stop illegal mining and recovery of compensation from violators.

Chadha has submitted a petition that seeks penalties from respondents - Chief Secretary; Secretary, industry; Secretary, mining; Deputy Commissioner, Ropar, and Chair of the Central Pollution Control Board to violate the order of this court based on Section 26 of the NGT Law, 2010.  Observing that failure to obey the court order is a criminal violation that can be punished for a period of up to three years or with a fine of up to Rs10 crore, the NGT order states that under Section 30 NGT ACT, 2010, the provisions of a violation can be taken by a Metropolitan judge or judicial magistrate first class.   The tribunal jurisdiction did not extend to conduct a trial for violations, according to the scheme of the law, stating the sequence of the court headed by Justice Adarsh Kumar Goel, judge justice Sheo Kumar Singh, and members of expert Dr. Nagin Nanda.  In 2017, district administrative officials during their visit to various mines found illegal mining and not regulated. Chadha has approached NGT in 2018 to seek actions against violators and courts request a committee with the Central Pollution Control Board, Director (mining), and Punjab Pollution Control Agency to stop illegal mining.
